Meicheng Mooncake "Manufacturer: There is no law that stipulates that Hong Kong brands cannot be produced in the mainland, and the origin dispute has aroused heated debate
In the early stage of the Mid-Autumn Festival, the "Hong Kong high-end mooncake" Meicheng mooncake promoted by "Crazy Brother Yang" live stream attracted widespread attention. This mooncake is advertised as a Hong Kong brand, but in fact there is no offline point of sales in Hong Kong, and its production place is not Hong Kong, but Guangdong Province. The brand operation of Meicheng mooncake is handled by Guangzhou Meicheng Food Co., Ltd., and the production task is jointly undertaken by Guangzhou Meicheng Food Technology Co., Ltd. and Foshan Meicheng Food Co., Ltd.
On September 15, Human Resources of Guangzhou Meicheng Company showed its brand trademarks registered in Hong Kong to visiting reporters in the face of heated discussions on the Internet, and explained that the company has completed brand registration in Hong Kong since 2019. The person in charge expressed his frustration at the outside world’s doubts about the registration in Hong Kong and the production model in the mainland, and stressed that there is no legal provision prohibiting Hong Kong brands from setting up factories in the mainland.
However, from a legal point of view, Liu Kai of Beijing Zhongwen (Changsha) Law Firm pointed out that there are geographical restrictions on the legal protection of trademarks, that is, trademarks registered overseas do not automatically enjoy legal protection in China. Attorney Liu Kai further explained that if the packaging and publicity of Meicheng mooncakes make consumers mistakenly believe that the product is from Hong Kong, but the actual place of production is Guangzhou or Foshan, this behavior may involve false publicity and constitute fraud to consumers.
This incident has revealed the potential for misdirection in product marketing, reminding consumers to carefully discern the authenticity of product information when purchasing.
