The report does not recommend criminal charges against Biden, but mentions that Biden had a "poor memory" when he was questioned. Biden angrily retorted that his memory was "very good" and blamed his forgetfulness in the inquiry on the current Palestinian-Israeli conflict.

According to the report, the investigation involved whether Biden had improperly kept confidential documents during his tenure as a US senator and vice president. The 345-page report describes Biden as a "compassionate, well-intentioned old man with poor memory" and records in detail some basic facts about Biden’s personal experience and family that he can’t recall. According to the report, when interviewed by investigators in early October, 2023, Biden could not remember his tenure as vice president of the United States, and could not tell exactly when his son bo Biden died.

The report says, "When interviewed by our office, Mr. Biden’s memory got worse." On the first day of questioning at the White House, Biden couldn’t remember when his vice presidency ended. "If it’s 2013-when will I stop serving as vice president?" He asked, apparently not remembering that he stepped down as vice president in January 2017. The report also said, "He can’t remember when his son Bo died, even if it was about a few years."

Therefore, the special prosecutor concluded that Biden’s careless handling of confidential documents should not be prosecuted. The report argues that it will be difficult for the prosecution to convince the jury that he has the intention of intentional crime. "In the trial, Biden will probably show the jury that he is a compassionate, well-intentioned and poor memory, as we asked him … By then, he will be a former president in his eighties, and it will be difficult to convince the jury that he has committed a serious felony, and that needs to prove that he has a subjective and intentional psychological state."

According to the report, after the report was published, Biden responded angrily when he delivered a speech at the White House on the evening of the 8 th, saying that his memory was "very good" and defended him for seeking re-election for the US president, saying that he was "the most qualified person in this country to serve as president." Biden also said that when he was questioned, he was "dealing with an international crisis", that is, the current Israeli-Palestinian conflict.

"I have not sought to postpone (inquiry). As a matter of fact, I am determined to let the special prosecutors get what they need. In the two days of October 8 and 9 (last year), I accepted five hours of face-to-face inquiries, although Israel was just attacked on the 7 th, and I was dealing with an international crisis. " Biden said.

Biden also said in his speech, "Say that I am well-intentioned, I am an old man, and of course I know what I am doing. I am the president, and I have revived this country. I don’t need his recommendation letter. " He added, "I have a good memory." However, Fox News mentioned that when the follow-up speech turned to talk about the situation in the Middle East, Biden mistakenly described Egyptian President Seyce as the "Mexican" president.
